False statements that damage your reputationย  whether made in person, in a newspaper, or on social mediaย  are actionable under Indian law. India has both criminal and civil defamation remedies, giving victims multiple legal routes to protect their reputation and seek compensation.

What is Defamation Under Indian Law?

Defamation is making a false statement about a person to a third party that lowers that person’s reputation in the eyes of right-thinking members of society. Under Section 499 IPC (now BNS), defamation is a criminal offence punishable with imprisonment up to 2 years, fine, or both. India also recognises civil defamation as a tort โ€” allowing victims to sue for monetary damages in civil court.

Criminal vs Civil Defamation

Criminal Defamation (Section 499/500 IPC/BNS): File a private complaint before a Magistrate. If the Magistrate finds prima facie caseย  the accused is summoned. Punishment up to 2 years imprisonment. This route is often more effective as the threat of criminal proceedings compels the defamer to settle and publish a retraction.

Civil Defamation (Tort Law): File a civil suit in District Court claiming monetary damages for loss of reputation, business losses, and mental anguish. Courts award significant damages in proven cases.

Online Defamation โ€” Additional Legal Remedies

For defamatory content on social media, WhatsApp, blogs, or YouTubeย  additional IT Act provisions apply. Section 66A IT Act (now struck down) has been replaced by Section 67 for obscene content. Section 500 IPC combined with IT Act Section 66 covers online defamation. Report defamatory content at cybercrime.gov.in and simultaneously send a legal notice to the publisher. Defences to Defamation

Truth is an absolute defenceย  if the statement made is true, it is not defamation (criminal) even if it damages reputation. Fair comment on matters of public interest is also a defence. Privileged statements (made in Parliament, court proceedings) cannot be the basis of defamation suits.
