Provident Fund is one of the most important retirement savings for salaried employees yet PF withdrawal rejections, employer non-deposit, and claim delays affect millions of workers across India. Furthermore, many employees discover only after resignation that their employer deducted PF from their salary but never actually deposited it with EPFO. Consequently, knowing how to verify your PF balance, claim your money, and take legal action against defaulting employers is essential for every salaried person. Your Rights Under the EPF and MP Act, 1952

Every employee earning below the threshold wage (currently Rs 15,000 per monthย  though many employers cover all employees) in an establishment with 20 or more employees is entitled to EPF coverage. Specifically, your rights include: employer contribution of 12% of basic salary plus DA to your PF account, your own contribution of 12% deducted from your salary, interest on the accumulated PF balance at rates declared annually by the EPFO (currently 8.15%), right to withdraw PF on resignation after 2 months of unemployment, and right to partial withdrawal for specific purposes medical treatment, home purchase, marriage, and education. Furthermore, the entire PF amount belongs exclusively to you the employer has no claim over it under any circumstances.

How to Verify Your PF Balance and Employer’s Deposits

Step 1 โ€” Check Through UAN Portal Activate your Universal Account Number (UAN) at epfindia.gov.in. Furthermore, log in with your UAN and password to view: your complete PF passbook showing all employer and employee contributions month-by-month, interest credited each year, any transfers from previous employers, and any partial withdrawals made. Importantly, if your employer deducted PF from your salary but the passbook shows no corresponding employer deposit for those months your employer is committing a serious legal violation.

Step 2 โ€” Download and Verify the Passbook Download your EPF passbook and check each month’s entry. Specifically, every month should show: Employee Share (your 12% contribution), Employer Share (employer’s 12% contribution), and interest credit annually. Claiming PF โ€” How to Withdraw

For Full Withdrawal (After Resignation and 2 Months Unemployment): Log in at epfindia.gov.in with your UAN and password. Specifically, navigate to “Online Services” and select “Claim (Form-31, 19 & 10C).” Furthermore, verify your KYC details Aadhaar, bank account, and PAN must be linked and verified. Moreover, select “Full EPF Settlement” if you want the complete amount after resignation. For Partial Withdrawal: Partial withdrawal is available for specific purposes medical treatment (no minimum service period), house purchase or construction (5 years minimum service), marriage (7 years minimum service), and education (7 years minimum service). Furthermore, partial withdrawal limits are specified as percentages of your accumulated balance โ€” typically 50% to 90% depending on purpose. Consequently, submit partial withdrawal claims online through the EPFO portal with the required supporting documents.

When to File an EPFO Grievance

File a grievance at epfindia.gov.in under “Grievance” when: your PF claim is rejected without clear reason, your PF claim has been pending for more than 20 working days, your employer has not deposited PF contributions despite deducting from your salary, you cannot transfer PF from a previous employer, or your UAN has incorrect details that prevent claim processing. Furthermore, EPFO must acknowledge your grievance within 3 working days and resolve it within 30 days. Consequently, formal grievances create accountability and a documented trail for subsequent escalation.

Taking Legal Action Against a Defaulting Employer

Step 1 โ€” File Complaint With EPFO Regional Commissioner If your employer is not depositing PF despite deducting from your salary file a written complaint with the EPFO Regional Commissioner, Visakhapatnam. Specifically, the EPFO has powers to: conduct a surprise inspection of the employer’s premises, issue demand notices for all unpaid PF contributions, impose damages (penalties) on the employer ranging from 5% to 25% of arrears, and initiate prosecution under Section 14 EPF Act punishable with imprisonment up to 3 years. Consequently, the EPFO takes employer default complaints very seriously because it undermines the entire social security framework.

Step 3 โ€” File Criminal Complaint Against Employer EPF deduction without deposit is criminal breach of trust under Section 406 IPC punishable with up to 3 years imprisonment. Furthermore, file an FIR against the employer’s directors personally not just the company because they are personally liable for this criminal default. Consequently, the threat of personal criminal prosecution against directors motivates faster compliance than regulatory complaints alone.

Step 4 โ€” File Civil Recovery Suit File a civil recovery suit for the total PF amount not deposited plus damages and interest. Moreover, simultaneously apply for an attachment order against the company’s assets to secure the recovery before the company dissipates its assets. Consequently, civil and criminal proceedings simultaneously create maximum pressure for recovery.

Q: My PF claim was rejected because my UAN is not linked with Aadhaar. How do I fix this?
Link your Aadhaar with your UAN through the EPFO member portal at epfindia.gov.in under “KYC.” Furthermore, your Aadhaar linking requires OTP verification to your Aadhaar-registered mobile number. Moreover, if your employer has not approved the Aadhaar KYC follow up with your HR department specifically requesting KYC approval. No โ€” this is incorrect. Specifically, you can withdraw your full PF balance after 2 months of unemployment following resignation regardless of your age.
