Contempt of Court in India: Types, Punishment and Defence

What is Contempt of Court?
Contempt of court is any act that disrespects, disobeys, or interferes with the authority of the court or its orders. It is governed by the Contempt of Courts Act, 1971 and the inherent powers of the High Court under Article 215 of the Constitution.
Types of Contempt
Civil Contempt: Wilful disobedience of any judgment, decree, order, or undertaking given to the court. Most common examples: refusing to pay court-ordered maintenance, violating injunction orders, continuing construction despite stay, refusing to hand over custody of child as per court order, and not paying decreed amounts. Punishment: imprisonment up to 6 months, fine up to Rs 2,000, or both.
Criminal Contempt: Publishing content that scandalises the court, prejudices the outcome of ongoing cases (sub judice), or interferes with the administration of justice. Punishment: imprisonment up to 6 months, fine up to Rs 2,000, or both.
How to File Contempt Petition
If someone is disobeying a court order against you: file a contempt petition before the same court that passed the original order (or the High Court). Attach the original order and evidence of disobedience. The contemnor is summoned to explain why they should not be punished for contempt. If found guilty โ court passes punishment.

Courts distinguish between wilful disobedience and genuine inability to comply โ only wilful disobedience is punishable.
