Millions of people in Visakhapatnam and across Andhra Pradesh live as tenants. Many face harassment โ illegal rent hikes, wrongful eviction, security deposit disputes, and landlord threats. Indian law provides strong protections for tenants. Knowing your rights is the first step to protecting yourself.
Always Have a Written Rent Agreement
A written rent agreement signed by both landlord and tenant is critical. It establishes the agreed rent, security deposit amount, duration of tenancy, notice period for termination, and maintenance responsibilities. Without a written agreement โ disputes become very difficult to resolve. Register the agreement at the Sub-Registrar’s Office for agreements of 12 months or more.
Tenants Cannot Be Evicted Without Court Order
A landlord cannot forcibly evict a tenant โ even if rent is unpaid. Illegal eviction by changing locks, cutting electricity/water, or removing the tenant’s belongings is a criminal offence under Section 441 IPC (criminal trespass) and can also result in civil damages. Only a court can order eviction through a formal eviction suit.
Grounds for Lawful Eviction
Under the AP Buildings (Lease, Rent and Eviction) Control Act โ landlords can seek eviction only on specific grounds: non-payment of rent for 2+ months, subletting without permission, causing damage to the property, the landlord genuinely needing the property for personal use, and expiry of lease period with notice.
Security Deposit Rights
Security deposit must be returned at the end of tenancy after deducting legitimate repair costs. Landlords cannot withhold the entire security deposit without justification. Minor day-to-day maintenance (painting, minor fixtures) may be the tenant’s responsibility depending on the agreement. Always specify this clearly in the rent agreement.
