Credit card fraud — unauthorised transactions, card skimming, phishing attacks, and card cloning causes enormous financial loss to cardholders across India. Furthermore, many victims do not know their rights or how to recover their money. However, the RBI’s customer protection guidelines give cardholders strong rights against unauthorised transactions — including zero liability in certain circumstances. Common Types of Credit Card Fraud in India
Card Skimming: Fraudsters attach a device to ATMs or POS terminals that reads and copies your card’s magnetic stripe data. Furthermore, they create a cloned card and use it for fraudulent purchases. Specifically, insert your card only in machines that have not been tampered with look for loose card readers or unusual devices.
Phishing: You receive a fake email or SMS appearing to be from your bank — asking you to click a link and enter your card details. Moreover, the fraudsters then use your card number, CVV, and OTP to make unauthorised transactions. Consequently, never click links in SMS or emails claiming to be from your bank always access your bank through the official app or website directly.
Online Skimming (Magecart Attacks): Fraudsters inject malicious code into e-commerce websites that captures your card details at the time of payment. Furthermore, you only discover the fraud later when you see unauthorised transactions on your statement. Consequently, use virtual cards or UPI for online payments whenever possible.
Social Engineering: A fraudster calls claiming to be a bank official, says your card has been “compromised,” and asks for your card number, CVV, and OTP to “verify” and “re-issue” the card. Importantly, genuine bank officials never ask for OTP or CVV over phone. Consequently, disconnect immediately if anyone asks for these details.
RBI Zero Liability Policy — Know Your Rights
The RBI’s Circular on Customer Protection in Unauthorised Electronic Banking Transactions provides significant protection. Specifically:
Zero Liability: You bear zero liability if the fraud occurred due to bank negligence or a third-party breach and you reported within 3 working days of discovering the fraud. Furthermore, zero liability also applies when the fraud occurred without your fault even if reported between 4 to 7 days, with maximum liability of Rs 5,000 to Rs 25,000 depending on your account type.
Your Liability Increases When: The fraud occurred due to your own negligence sharing OTP, writing PIN on the card, or accessing bank accounts on public computers. Moreover, delayed reporting beyond 7 days — significantly increases your liability. Consequently, report every suspicious transaction within 24 hours of discovery.
Step-by-Step Action Plan for Credit Card Fraud
Step 1 — Block the Card Immediately Call your bank’s 24-hour credit card helpline the moment you discover any unauthorised transaction. Specifically, request immediate card blocking. Furthermore, ask the helpline agent to register a formal fraud complaint get the complaint reference number. Consequently, card blocking prevents additional fraudulent transactions while you pursue recovery.
Step 2 — Send Written Complaint to Bank Within 3 Working Days Send a written complaint — email or written letter to the bank’s credit card department within 3 working days of discovering the fraud. Specifically, include: your card number (last 4 digits only in written communication), the date and amount of each unauthorised transaction, a statement that you did not authorise these transactions, and a demand for provisional credit while investigation proceeds. Step 3 — File RBI Banking Ombudsman Complaint If the bank refuses to refund or takes more than 90 days file a complaint with the RBI Banking Ombudsman at cms.rbi.org.in. Sharing OTP is treated as your own negligence which increases your liability.
